Conditions of Participation Competition  

General Terms and Conditions Competition  

1) Object  

1.1 These terms and conditions of participation and data protection information regulate the participation in all competitions of Collectors Wine World GmbH, Max-Keith-Straße 66, 45136 Essen (hereinafter referred to as the “organizer”) by the participants as well as the collection and use of the data collected or provided by the participants. The organizer is responsible for the operational management, which includes the selection of winners, communication and delivery of the prizes.  

1.2 This competition is in no way associated with American Express or any other provider on which this competition may be announced.  

1.3 By participating in the competition, participants accept these conditions of participation.  

1.4 The competition will take place between September 1, 2024 (00:00) and September 30, 2024 (23:59).  

2) Conditions of participation in the competition  

2.1 The competition takes place online at collectorswineworld.com. Participants can take part in the competition at collectorswineworld.com.  

(1) To take part in the prize draw, you must purchase a package of 3 wines from the “Chateau D'Agiuilhe wine package of 3” offer in the American Express Experience app between September 1, 2024 and September 30, 2024 at 11:59 p.m. Participation is automatic when you purchase the above-mentioned offer. Alternatively, you can fill out the participation form on the collectorswineworld.com website and take part in the prize draw.  

The organizer collects the registrations, draws the winner and informs them.  

2.2 Persons aged 18 and over who are resident in Germany are eligible to participate. Legal entities, employees of the organizer and employees of cooperation partners who are or were involved in the creation or implementation of the competition are excluded.  

2.3 The prize includes a bottle of 0.75L Dom Pérignon Vintage 2013 including free delivery to the winner’s home  

 

2.4 Each participant may only take part in the competition once. Multiple entries are not permitted. The organizer reserves the right to exclude participants from the competition in the event of multiple entries in accordance with section 5.  

3) Settlement  

3.1 The prize cannot be paid out in cash, exchanged or transferred to another person. A participant can waive the prize. In this case, the next participant in the winners' ranking will take their place. The handover of the prizes will be coordinated individually with the participants, preferably the prizes will be sent by the organizer.  

3.2 Participants will be notified of their prizes promptly after the end of the competition via the contact details provided (email address) and asked to confirm.  

3.3 If a participant does not confirm acceptance of the prize within a period of 2 weeks, the prize will be forfeited. If the contact details provided are incorrect, the organizer is not obliged to find out the correct addresses. Any disadvantages resulting from providing incorrect contact details are at the participant's expense.  

4) Liability  

4.1 The organizer is liable without limitation if the cause of the damage is based on intent or gross negligence.  

4.2 Furthermore, the organizer is liable for the slightly negligent breach of essential obligations, on the fulfillment of which the participant can rely to a special degree. In this case, however, the organizer is only liable for foreseeable, contract-typical damage.  

4.3 The organizer is not liable for the negligent breach of non-essential contractual obligations.  

4.4 The above limitations or exclusions of liability do not apply in the event of injury to life, body or health, in the event of a guarantee being given or in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.  

4.5 To the extent that the organizer’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organizer.  

5) Exclusion of participants  

The organizer reserves the right to exclude participants from participating in the competition. This applies in particular in the event of culpable violations of the conditions of participation or if participants manipulate or attempt to manipulate the participation process or the competition or use other dishonest means.  

6) Privacy Policy  

6.1 The organizer collects, uses and stores participants' data only to the extent permitted by law or with the participants' consent. The data will not be passed on to third parties.  

6.2 The following data is collected from participants by the organizer and is used to design, carry out and process the competition: first and last name, address, email address, date of birth. The date of birth is used to determine admission to the competition (participation from 18 years of age).  

6.3 Upon written or textual request, participants may at any time request information from the organizer about which personal data is stored by the organizer, may request their correction or deletion, and may revoke consent to the use of data.  

7) Severability Clause  

Should individual provisions of these terms and conditions be invalid or contain a gap in the regulations, this shall not affect the validity of the remaining provisions.
Ineffective or missing provisions will be replaced by a provision that comes closest to the purpose of the contract. Legal recourse is excluded .  

8) Place of jurisdiction / applicable law  

In the event of disputes, German law applies exclusively. The place of jurisdiction is the registered office of the organizer, Essen. Legal recourse is excluded.
