GENERAL TERMS AND CONDITIONS
of COLLECTORS WINE WORLD GmbH
(Status: October 2025)
§ 1 Basic provisions
(1) The following General Terms and Conditions (“GTC”) apply exclusively to all contracts that you, as a customer, conclude with us as the provider (COLLECTORS WINE WORLD GmbH, Local Court of Essen, HRB 26307, Max-Keith-Straße 66, 45136 Essen, Germany, phone: +49 201 24694750, email: office@collectorswineworld.com) via our online shop on our website (https://collectorswineworld.com/). These GTC apply regardless of whether you are a consumer or an entrepreneur. Unless expressly agreed otherwise in writing (§ 126 German Civil Code), the inclusion of any supplementary, deviating or conflicting terms and conditions used by you is hereby rejected.
(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
(3) In accordance with the German Youth Protection Act, the conclusion of a contract with persons who are not of legal age is excluded. With every order placed via our online shop, you confirm that you have reached the age of 18. You are obliged to ensure that only you yourself or adult persons authorised by you to receive the delivery accept the goods. Upon delivery, the commissioned logistics service provider is entitled to request proof of age.
§ 2 Registration; processing of personal data
(1) You can order goods, event participation or courses in our online shop with or without prior registration. Registration requires the entry of your first name, last name, email address, telephone number and a freely selectable password. As a registered user, you do not have to enter your personal data every time, but can simply log in to your customer account using your email address and the password you selected during registration. Registration alone does not create any obligation to purchase the goods, event participation or courses offered by us. For information on the processing of your data, please read our Privacy Policy at https://collectorswineworld.com/policies/privacy-policy.
(2) You may have your registration or customer account deleted at any time by sending a corresponding notification by email to office@collectorswineworld.com. If your personal details change, you are responsible for updating them. All changes can be made online after logging in to your customer account.
§ 3 Conclusion of the contract; delivery
(1) The subject matter of the contract is the sale of goods, event participation or courses.
(2) The presentation and advertising of goods, event participation or courses in our online shop and on our website are non-binding and do not constitute a binding offer by us to conclude a purchase contract.
(3) The contract is concluded via the online shopping cart system in our online shop as follows: The goods or courses intended for purchase are placed in a so-called shopping cart using the “ADD TO CART” button. You can access the “shopping cart” via the corresponding button in the navigation bar and make changes there at any time. After accessing the “CHECKOUT” page via the corresponding button in the “shopping cart” and entering your personal data as well as the payment and shipping conditions, all order details are displayed again on the order overview page via the “Review order” button. If you use an instant payment system as your payment method, for example PayPal, Google Pay, Shop Pay or Klarna Pay, you will either be taken to the order overview page in our online shop or initially redirected to the website of the provider of the instant payment system. If you are redirected to the respective instant payment system, you make the relevant selection or enter your data there. You will then be redirected back to our online shop to the order overview page. Before submitting the order, you have the opportunity to check all details again, change them, including using the “back” function of your internet browser, or cancel the purchase. By submitting an order using the “order with obligation to pay” button, you place a legally binding order. You are bound to the order for a period of two weeks after placing the order; any existing right of withdrawal remains unaffected.
(4) We will confirm receipt of your order placed via our online shop without undue delay by email. Such an email does not yet constitute binding acceptance of the order unless, in addition to confirming receipt, it also expressly declares acceptance.
(5) A contract is only concluded when we accept your order by means of a declaration of acceptance, for example by separate email, or by delivering the ordered goods, event participation or by carrying out the course.
(6) The contractual provisions with details of the ordered goods, event participation and/or booked courses, including these GTC and the withdrawal instructions, will be sent to you by email upon acceptance of the order or upon notification thereof, or handed over at the latest upon delivery or execution of the course or event. We do not store the contractual provisions.
(7) If delivery of the goods ordered by you or the provision of the courses or event booked by you is not possible, for example because the relevant goods are not in stock or the event or course cannot take place, we will refrain from issuing a declaration of acceptance or from delivering or providing the service. In this case, no contract is concluded. We will inform you of this without undue delay and refund any consideration already received without undue delay.
(8) The contract is concluded in German.
§ 4 Prices, shipping costs, delivery
(1) All prices stated in our online shop are gross prices including statutory VAT and are exclusive of any applicable shipping costs.
(2) The shipping costs are stated in our online shop in the price information for the respective product. The price including VAT and any applicable shipping costs is also displayed on the order overview page before you submit the order. Special rules apply within Germany to members of the CWW Club in accordance with § 9. Excluded from this are costs and fees incurred in connection with export due to customs regulations.
(3) The delivery and service conditions as well as the delivery times are based on the information for the respective product in our online shop and on the information on the order overview page shortly before submitting the order. Delivery is made only to Germany, the Netherlands and Austria.
§ 5 Right of withdrawal
If you are a consumer, you have a right of withdrawal in accordance with the instructions set out at https://collectorswineworld.com/policies/refund-policy.
§ 6 Right of retention, retention of title
(1) You may only exercise a right of retention insofar as your counterclaims are recognised, undisputed or have been legally established, or are in a reciprocal relationship with a claim by us within the meaning of § 320 of the German Civil Code.
(2) The goods remain our property until the purchase price has been paid in full.
(3) If you are an entrepreneur, the following additionally applies:
a) We retain title to the goods until all claims arising from the ongoing business relationship have been settled in full. Before ownership of the goods subject to retention of title is transferred, pledging or transfer by way of security is not permitted.
b) You may resell the goods in the ordinary course of business. In this case, you hereby assign to us all claims in the amount of the invoice amount that accrue to you from the resale, and we accept this assignment. You remain authorised to collect the claim. If you do not properly meet your payment obligations, we reserve the right to collect the claim ourselves.
c) In the event of combination and mixing of the goods subject to retention of title, we acquire co-ownership of the new item in proportion to the invoice value of the goods subject to retention of title to the other processed items at the time of combination or mixing.
d) We undertake to release the securities to which we are entitled at your request insofar as the realisable value of our securities exceeds the claim to be secured by more than 10%. The selection of the securities to be released is at our discretion.
§ 7 Warranty
(1) The statutory rights for defects apply. If the goods purchased and delivered in our online shop are defective, you are entitled, within the framework of the statutory provisions, to demand supplementary performance, withdraw from the contract or reduce the purchase price. If you are a consumer, the limitation period for statutory claims for defects is two years and begins with delivery of the goods.
(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify us and the supplier of any complaints as quickly as possible. Failure to do so has no effect on your statutory warranty claims.
(3) If you are an entrepreneur, the following applies in deviation from the above warranty provisions:
a) Only our own information and the manufacturer’s product description are deemed to be agreed as the quality of the item, but not other advertising, public promotions or statements by the manufacturer.
b) In the event of defects, we are initially obliged and entitled, at our discretion to be exercised within a reasonable period, to remedy the defect by repair or to deliver a defect-free item as a replacement. Our right to refuse the selected type of supplementary performance under the statutory conditions remains unaffected. You may only withdraw from the contract or reduce the purchase price appropriately if supplementary performance has failed or if a reasonable deadline set by you for supplementary performance has expired unsuccessfully or is dispensable under the statutory provisions. Supplementary performance is deemed to have failed if two attempts at supplementary performance have been unsuccessful, unless the nature of the item or defect or other circumstances indicate otherwise, or if supplementary performance is impossible or unreasonable for you.
c) The warranty period is one year from delivery of the goods. The shortening of the period does not apply to the limitation of claims due to injury to life, body or health, nor to the limitation of mandatory statutory claims such as those under the German Product Liability Act and in the event that we assume a guarantee. It also does not apply to the limitation of your claims based on the fact that we fraudulently concealed defects in goods delivered by us or services provided by us, or that we intentionally or grossly negligently breached a duty. In these cases, the statutory warranty periods apply to the limitation of these claims.
§ 8 Liability
(1) We are liable only for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance you may regularly rely (material contractual obligation). In the latter case, however, we are liable only for the foreseeable damage typical for the contract. The same applies to breaches of duty by our vicarious agents.
(2) The above exclusions and limitations of liability do not apply insofar as our liability is mandatory due to statutory provisions, such as the German Product Liability Act, where we have assumed a guarantee, in the case of fraudulent intent, or if claims are asserted against us due to culpable injury to life, body or health.
§ 9 CWW Club
(1) Participation in the CWW Club is voluntary for customers and does not involve any additional costs. The benefits are non-transferable, apply exclusively to the registered customer and are only valid in the online shop of Collectors Wine World GmbH.
(2) Membership is granted after reaching a defined annual turnover (gross goods value). The calculation of the annual turnover begins on 3 November 2025. Turnover prior to this date is not taken into account. Costs for storage rental and En Primeur purchases (subscription) are excluded from the turnover calculation. The customer reaches the Collector level from an annual turnover of €750 and the Curator level from €7,500 within 12 months from 3 November 2025. Activation takes place by confirming membership via the link contained in the email.
(3) Membership is valid for 12 months from the time of activation. It ends automatically if the required minimum turnover is not reached again in the following year. Separate termination is not required in this case. Early termination is possible in writing by email to office@collectorswineworld.com.
(4) Collectors Wine World reserves the right to change or discontinue the club concept at any time. Changes will be announced on the website in good time.
§ 10 Choice of law, place of performance, place of jurisdiction, alternative dispute resolution
(1) The law of the Federal Republic of Germany applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods. If you placed the order as a consumer and had your habitual residence in another country at the time of your order, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.
(2) If you are an entrepreneur, the place of performance and exclusive place of jurisdiction for all disputes and claims arising from or in connection with the specific contractual relationship into which these GTC have been incorporated is Essen, unless mandatory statutory provisions provide otherwise. However, we also have the right to bring legal action against you at your general statutory place of jurisdiction.
(3) The above provision in § 9(2) applies accordingly if you are a consumer and, at the time of concluding the contract, had your place of residence or habitual residence in Germany and either moved it out of Germany at the time legal action is brought by us or your place of residence or habitual residence is unknown at that time.
(4) The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), available at https://consumer-redress.ec.europa.eu/index_de/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
