Right of withdrawal for consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

- on which you or a third party named by you, who is not the carrier, has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together;

- on which you or a third party named by you, who is not the carrier, has taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;

- on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last item, provided that you have ordered goods that are delivered in several partial shipments or items;

- on which you or a third party named by you, who is not the carrier, has taken possession of the first goods, provided that you have ordered goods that are delivered regularly over a specified period of time;

- or, in the case of the purchase of courses, from the day on which the contract is concluded.

To exercise your right of withdrawal, you must inform us (COLLECTORS WINE WORLD GmbH, Max-Keith-Straße 66, 45136 Essen, telephone number: +49 201 24694750, email address: office@collectorswineworld.com) by means of a clear statement, for example a letter sent by post or an email, of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs, with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us, without undue delay and no later than within 14 days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than within fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their condition, properties and functioning.

Exclusion or expiry of the right of withdrawal

The right of withdrawal does not apply to contracts

- for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer, for example if the consumer has ordered personalised labelling;

- for the delivery of goods that can spoil quickly or whose expiry date would be exceeded quickly, for example if the consumer has ordered wines with a short shelf life or special storage requirements;

- for the delivery of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on market fluctuations over which the entrepreneur has no influence, for example if the consumer has ordered wines with a variable or speculative market price.

The right of withdrawal expires prematurely in the case of contracts

- for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery, for example if the consumer has ordered wines that contain a freshness or hygiene seal;

- for the delivery of goods if, after delivery, they have been inseparably mixed with other goods due to their nature, for example if the consumer has ordered wines that are mixed with other liquids after delivery.
