General Terms and Conditions for Sweepstakes
1) Subject Matter
1.1 These terms and conditions of participation and data protection notices govern participation in all sweepstakes held by Collectors Wine World GmbH, Max-Keith-Straße 66, 45136 Essen (hereinafter referred to as the "Organizer") by participants, as well as the collection and use of data collected from or provided by participants.
1.2 By participating in the sweepstakes, participants accept these terms and conditions.
2) Sweepstakes Terms of Participation
2.1 The sweepstakes will take place online. Participation must be completed by June 4, 2022, 11:59 PM. Online entries will be collected by the Organizer, and the winner will be drawn.
2.2 Eligible participants are individuals aged 18 and over residing in Germany. Employees of the Organizer, as well as employees of cooperation partners who are or were involved in the creation or execution of the sweepstakes, are excluded.
2.3 The prizes are as follows:
- Drawing for 3x Magnum bottles of Slice of Pleasure 2021 and 3x 6-piece Slice of Pleasure glass sets.
2.4 Each participant may only enter the sweepstakes once. Multiple entries are not permitted. The Organizer reserves the right to exclude participants from the sweepstakes in the event of multiple entries, in accordance with section 5.
3) Procedure
3.1 A cash payout of the prize, its exchange, or transfer to other persons is not possible. A participant may waive the prize. In this case, the next participant in the winner ranking will take their place. The handover of prizes will be arranged individually with the participants; preferably, the prizes will be shipped by the Organizer.
3.2 Participants will be notified of their winnings promptly via the provided contact details (direct message on Instagram) and asked for confirmation.
3.3 If a participant does not confirm acceptance of the prize within a period of 2 weeks, the prize will be forfeited. If the contact options provided are incorrect, the Organizer is not obligated to ascertain correct addresses. Disadvantages resulting from incorrect contact details are the responsibility of the participants.
4) Liability
4.1 The Organizer is liable without limitation insofar as the cause of damage is based on intent or gross negligence.
4.2 Furthermore, the Organizer is liable for the slightly negligent breach of essential duties on whose fulfillment the participant may particularly rely. In this case, however, the Organizer is only liable for the foreseeable, typical damage for the contract.
4.3 The Organizer is not liable for the slightly negligent breach of non-essential contractual duties.
4.4 The foregoing limitations or exclusions of liability do not apply in cases of injury to life, limb, or health, in the event of assuming a guarantee, or in cases of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
4.5 Insofar as the liability of the Organizer is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents of the Organizer.
5) Exclusion of Participants
The Organizer reserves the right to exclude participants from participating in the sweepstakes. This applies in particular to culpable breaches of the terms and conditions of participation or if participants manipulate or attempt to manipulate the participation process or the sweepstakes, or use other dishonest means.
6) Data Protection Notice
6.1 The Organizer collects and uses participant data only to the extent permitted by law or if participants consent thereto.
6.2 The following data will be collected by the Organizer from participants and used for the design, execution, and processing of the sweepstakes: first name and last name, address, email address, date of birth. The date of birth is used to determine eligibility for the sweepstakes (participation from 18 years of age).
6.3 Upon written request or a request communicated in text form, participants may at any time request information from the Organizer about which personal data is stored by the Organizer, request its correction and deletion, and revoke data usage consents.
7) Severability Clause
Should individual provisions of these terms and conditions of participation be ineffective or a regulatory loophole exist, this shall not affect the validity of the remaining provisions.
An ineffective or missing provision shall be replaced by a provision that comes closest to the purpose of the contract.
8) Jurisdiction / Applicable Law
In case of disputes, German law shall apply exclusively. The place of jurisdiction, insofar as legally permissible, shall be the registered office of the Organizer. Legal recourse is excluded.
